Status of the action for rescission

Berlin, 13 October 2008 - MAGIX AG announces that the action for rescission against the decision by the shareholder's meeting on the authorization to buy back own shares in accordance with § 71 section 1, no. 8 AktG as put forward by shareholders Pomoschnik Rabotajet GmbH and Klaus E. H. Zapf, was rejected by the Berlin District Court during the court hearing on 30 July 2008 at first instance. The intervention by shareholder Frank Scheunert was also rejected. Shareholder Pomoschnik Rabotajet GmbH has filed an appeal against the decision of the Berlin District Court. With regard to the rejection of the intervention shareholder Frank Scheunert reprehends the breach of legal hearing and also filed an immediate appeal against the rejection of the intervention.
